ORDINANCE SUMMARY
SUMMARY OF URGENCY ORDINANCE, PURSUANT TO GOVERNMENT CODE SECTION 65858, ENACTING AN URGENCY ORDINANCE AMENDING TITLE 10 (ZONING AND SITE DEVELOPMENT) OF THE LOS ALTOS HILLS MUNICIPAL CODE TO ADD ARTICLE 15 TO CHAPTER 1 ESTABLISHING REGULATIONS FOR THE SUBDIVISION AND DEVELOPMENT OF QUALIFIED SENATE BILL 9 PROPERTIES
NOTICE IS HEREBY GIVEN that on November 18, 2021, the Los Altos Hills City Council will consider the introduction and adoption of an interim urgency ordinance that would add Article 15 to Chapter 1 of the Los Altos Hills Municipal Code to establish regulations for properties eligible for subdivision and/or development under Senate Bill 9 (2021) (“SB 9”). The urgency ordinance would initially be in effect for forty-five (45) days from its date of adoption unless extended by the City Council. If adopted, the interim urgency ordinance would create sets of regulations imposing requirements relating to the ministerial review of subdivision of qualifying lots and the development of up to two (2) units of residential projects on both subdivided and non-subdivided lots. The urgency ordinance would set forth the permitted locations, allowable number of units, and applicable objective development standards such as lot size, unit height and width, maximum floor area, and objective design standards, for SB 9 lot split and residential development projects. As set forth in the urgency ordinance, adoption of the ordinance would avoid land use and site development conflicts with existing regulations and prevent incompatibilities including public safety, visual, privacy, acoustic and aesthetic impacts which would negatively impact the public welfare and the unique quality and character of the Town. It would also allow for additional time for the Town to review, draft, consider, and adopt new and permanent SB 9-related development regulations.
Adoption of the proposed ordinance is not subject to the California Environmental Quality Act under the general rule in CEQA Guidelines Section 15061(b)(3) that CEQA applies only to projects which have the potential for causing a significant effect on the environment. For the reasons set forth in the urgency ordinance, it can be seen with certainty that there is no possibility that this ordinance will have a significant effect on the environment.
